Terms of Service

1. Eligibility and Authority

You may use the Services only if you are legally able to enter into a binding agreement and, if you are using the Services on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Accounts and Access

• You are responsible for maintaining the confidentiality of your login credentials.
• You are responsible for all activity that occurs through your account.
• You must provide accurate and current account information.
• You must promptly notify us of unauthorized access or suspected security issues.

3. Use of the Services

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable right to access and use the Services for your internal business purposes.

You may not:

• interfere with or disrupt the integrity, performance, or security of the Services;
• attempt to gain unauthorized access to any account, system, or data;
• reverse engineer, copy, or create derivative works from the Services except as permitted by applicable law;
• use the Services to violate applicable law or the rights of others.

4. Customer Data and Integrations

You retain responsibility for the data you submit to or process through the Services, including data obtained from third-party integrations such as Stripe. You represent that you have all rights, permissions, and notices necessary to provide that data to us for processing in connection with the Services.

5. Third-Party Services

The Services may interoperate with third-party providers, including payment, billing, hosting, and analytics services. Your use of those third-party services is governed by their terms and policies, and we are not responsible for third-party products or services.

6. Fees, Billing, and Plan Limits

Paid features may require a subscription or other fees. By purchasing a paid plan, you authorize us and our billing providers to charge the applicable fees, taxes, and renewals unless canceled.

• Free plans, trials, and paid plans may include usage caps or other feature limitations.
• We may suspend or limit access if payment is overdue or if your usage exceeds plan limits.

7. Intellectual Property

We and our licensors retain all right, title, and interest in and to the Services, including all software, content, branding, designs, and related intellectual property rights. Except for the limited rights expressly granted in these Terms, no rights are transferred to you.

8. Feedback

If you provide suggestions, feedback, or ideas about the Services, you grant us a worldwide, perpetual, irrevocable, royalty-free right to use and incorporate that feedback without restriction or obligation to you.

9. Disclaimers

The Services are provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation.

10. Limitation of Liability

To the maximum extent permitted by law, MonetizationApps and its affiliates, officers, employees, and service providers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenues, data, or goodwill arising out of or related to the Services. Our aggregate liability arising out of or related to the Services will not exceed the amounts you paid to us for the Services during the twelve months before the event giving rise to the claim.

11. Indemnification

You will defend, indemnify, and hold harmless MonetizationApps and its affiliates, officers, employees, and agents from and against claims, liabilities, damages, losses, and expenses arising out of or related to your use of the Services, your data, or your violation of these Terms or applicable law.

12. Suspension and Termination

We may suspend or terminate your access to the Services if you violate these Terms, if required by law, or if continued service creates security, legal, or operational risk. You may stop using the Services at any time. Sections that by their nature should survive termination will survive.

13. Changes to the Services or Terms

We may modify the Services or these Terms from time to time. If we make material changes, we may provide notice through the Services or by other reasonable means. Your continued use after the effective date of updated Terms constitutes acceptance.
